What is an Article 4 Direction?

An Article 4 direction enables the local planning authority to withdraw permitted development (PD) rights including changes of use from an area or a particular property.

PD rights are a national grant of planning permission which allow certain building works and changes of use to be carried out without having to make a planning application under the Town and Country Planning (General Permitted Development) (England) Order 2015. These rights can be withdrawn under Article 4(1) of the order if there is a justification for both its purpose and extent.

Proposed Article 4 direction

Two non-immediate Article 4 direction have been proposed for the removal of PD rights for the following changes of use:

  • Light industrial to residential use
  • Office to residential use

The Direction relates to the following sites in Newhaven

Beach Road Trading Estate

Bevan Funnell

Denton Island

Eastside North

Eastside South

Railway Road Industrial Estate

Town Centre

When do they take effect?

A non-immediate Article 4 direction has been proposed under Article 4(1) to withdraw PD rights after 12 months’ notice. This was approved by Lewes District Council Planning Applications Committee on 11th October 2017 and confirmed by Planning Applications Committee on 27th June 2018 and will come into force on 5th November 2018, removing PD rights for any changes of use listed above.
